Mindora End-User Terms of Service
These End-User Terms of Service ("Terms") constitute a binding and enforceable agreement between LiteWorks LLC, doing business as Mindora ("Mindora," "we," "us," or "our"), and you ("User," "you," or "your") each time you access or use the Mindora Services.
Mindora and User may be referred to collectively as the "Parties" and individually as a "Party."
By accepting these Terms electronically or by accessing or using the Services, you agree to comply with these Terms. If you do not agree, you may not use the Services.
ARBITRATION NOTICE FOR USERS IN THE UNITED STATES
THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND A WAIVER OF RIGHTS TO BRING A CLASS ACTION AGAINST US. EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED BELOW, YOU AND MINDORA AGREE THAT DISPUTES WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND BOTH PARTIES WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION. YOU HAVE THE RIGHT TO OPT OUT AS DESCRIBED BELOW.

2. The Services
2.1 Description of Services
Mindora provides access to a subscription-based digital platform (the "Services"). By subscribing, you gain access to available content during your active subscription period.
2.2 Subscription Renewal
Monthly subscriptions automatically renew at the end of each billing cycle unless canceled prior to renewal.
2.3 Content Availability
Mindora reserves the right to add, remove, or modify content at any time without notice. We do not guarantee continuous availability of any specific content.
2.4 Third-Party Content
Certain content may be provided by third parties. Mindora is not responsible for the content, accuracy, or functionality of third-party materials.
2.5 Billing Descriptor
Subscription charges may appear on your billing statement as "Mindora" or our payment processor’s name.
3. Account Registration and Requirements
3.1 Account Creation
You must create an account and provide accurate, current, and complete information.
3.2 Eligibility
By using the Services, you represent and warrant that:
You are at least 18 years old (or the age of majority in your jurisdiction)
You have legal capacity to enter into this agreement
All information provided is truthful and accurate
You will not use the Services for unlawful or fraudulent purposes
3.3 Account Security
You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of unauthorized use.
4. Restrictions of Use
You agree to comply with all applicable laws and regulations. You may not:
Access the Services through unauthorized means
Circumvent security features
Share your account credentials
Reverse engineer, decompile, or disassemble the platform
Upload or transmit unlawful or infringing content
Use bots or automated systems without authorization
Copy, modify, or distribute content without permission
Use the Services to build a competing product
5. Subscription and Payments
5.1 Authorization
By subscribing, you authorize Mindora to charge your payment method at the beginning of each billing cycle.
5.2 Payment Responsibility
You must maintain a valid payment method. Failed payments may result in suspension or termination.
5.3 Taxes
All fees are exclusive of applicable taxes.
5.4 Price Changes
We may change subscription prices with 30 days’ notice. Changes apply to the next billing cycle.
5.5 Cancellation
You may cancel at any time by contacting support. Cancellation takes effect at the end of the current billing period.
5.6 Refunds
Refunds are handled in accordance with our Refund Policy.
5.7 Payment Provider Charges
Your payment issuer may impose additional charges; Mindora is not responsible for such fees.
6. Refund Policy

Refunds are provided in accordance with applicable law and our Refund Policy.
6.2 Refund Eligibility
Refunds may be available for:
Unused portions of subscriptions canceled within 7 days of purchase or renewal
Technical issues preventing access that cannot be resolved within 48 hours
Failure to deliver Services as described
Refunds are not available for:
Subscriptions substantially used
Daily subscriptions after access begins
Suspected fraud or abuse

6.4 Chargebacks
Initiating a chargeback may result in suspension or termination. Contact support before disputing a charge.

Mindora may collect and process Personal Data including:

Email address
IP address
Subscription data
Usage data
Billing information
As described in our Privacy Policy.
7.2 Ownership
You retain ownership of your Personal Data. You grant Mindora a limited license to process it as necessary to provide Services.
7.3 Compliance
We process data in accordance with applicable laws including GDPR, CCPA, and other relevant regulations.
8. Intellectual Property Rights
8.1 Ownership
Mindora owns all rights, title, and interest in the Services and platform.
8.2 License
You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial use during your subscription.
8.3 Third-Party Rights
Third-party content remains owned by its respective licensors.
9. Warranties; Disclaimers; Limitation of Liability
9.1 Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDORA SHALL NOT BE LIABLE FOR:
LOST PROFITS
LOSS OF DATA
INDIRECT OR CONSEQUENTIAL DAMAGES
9.3 Liability Cap
MINDORA’S MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU DURING THE 12 MONTHS PRECEDING THE CLAIM.
10. Termination
10.1 By You
You may terminate by canceling your subscription.
10.2 By Mindora
We may suspend or terminate access if:
You breach these Terms
Engage in fraud or illegal activity
Payment fails
Required by law
We discontinue Services
10.3 Effect of Termination
Access ends immediately. Refunds are provided only as required by law or policy.
Certain provisions survive termination.
11. Dispute Resolution and Arbitration
11.1 Arbitration
For U.S. users, disputes shall be resolved by binding arbitration in Wilmington, Delaware, administered by JAMS under its Comprehensive Arbitration Rules.
Arbitration must be individual (no class actions).
11.2 Opt-Out
You may opt out within 30 days of first accepting these Terms by sending written notice to:

12. General Provisions
12.1 Entire Agreement
These Terms constitute the entire agreement between you and Mindora.

12.4 Governing Law
These Terms are governed by the laws of the State of Delaware.
12.5 Assignment
You may not assign these Terms. Mindora may assign without restriction.

Nothing creates a partnership or joint venture.
